HON'BLE SRI JUSTICE S. RAVI KUMAR C.R.P No.5497 of 2001 ORDER:

This Revision is filed questioning order dated 01.02.1994 in I.A.No.579 of 1986 in O.S.No.348 of 1970 whereunder trial Court closed that petition in view of common order dated 01.02.1994 in I.A.No.882 of 1978 and I.A.No.61 of 1993. In the year 2003 this Court directed office to issue notice to revision petitioners as advocate who filed revision is passed away. On receiving notice, Sri Nazir Ahmed Khan filed vakalat for petitioners.

Advocate for petitioners sought time on the ground that bundle is lost and he wants to take steps, but I am not inclined to give any further time, since no interest is evinced in prosecuting the case. Further there is no material to show whether common order on the basis of which I.ANo.579 of 1986 is closed, is challenged or not. 3.

For these reasons, I am of the view that petitioners are not interested in prosecuting the case and this petition is liable to be dismissed.

Accordingly, this Civil Revision Petition is dismissed for non-prosecution. No costs. Miscellaneous Petitions, if any pending in this revision petition, shall stand closed.
