THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION No.2003 OF 2018 ORDER:

Heard the revision before ordering notice to the respondents and perused the impugned order and the grounds.

In fact, there is nothing to impugn the order of the lower court, which rightly recited that once there is a GPA executed by virtue of the contractual authorization, the party can depose those facts within personal knowledge pursuant to the GPA. This is no doubt not a bar from any person can be a competent witness as described in Sections 118 and 119 of the Indian Evidence Act, if he wants to depose not only as G.P.A. holder, but also as otherwise a competent witness of the facts within his knowledge otherwise than as a GPA including those facts earlier to the GPA.

With the above observations, the revision is disposed of, for nothing to admit or keep pending. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
