THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 32730 of 2010 Order:

This Writ Petition was filed challenging the action of the first respondent in issuing proceedings dated 04.11.2010 addressed to the second respondent for appropriate instructions to the Assistant Commissioner, Nellore to stop conducting auctions for the lands including the lands held by the petitioners.

When the matter is taken up for consideration, learned counsel appearing for the fourth respondent produced before this Court a copy of the order in W.P. No.29547 of 2010 dated 11.03.2014 passed in respect of other lessees covered by the same proceedings and submitted that the auction is being conducted after setting aside the proceedings dated 04.11.2010 in the said Writ Petition.

In view of the same, no separate order is necessary for setting aside the present proceeding dated 04.11.2010 which was already set aside in W.P. No.29547 of 2010 dated 11.03.2014. The Writ Petition is, accordingly, allowed in terms of the said order. There shall be no order as to costs. The Miscellaneous Petitions pending, if any, shall stand closed.
