THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.8350 of 2016 ORDER:

This petition under Section 482 Cr.P.C. is filed by the petitioner/A.5 seeking to direct the Additional Junior Civil Judge, Srikalahasthi, Chitoor District, to return the passport bearing No.Z2697903 to the petitioner in connection with Crime No.36 of 2015 of B.N.Kandriga Police Station, Chittoor District.

2. Heard learned counsel for the petitioner/A.5 and learned Additional Public Prosecutor representing the State.

3. During the course of hearing, it is brought to the notice of this Court that the learned Magistrate has passed an order on 31.05.2016 in Crl.M.P.No.216 of 2016 directing return of passport to petitioner/A.5 on certain conditions. However when a memo was filed to return the passport, on 03.06.2016 the learned Magistrate returned the said memo and subsequently passed orders directing impounding of passport.

4. In that view of the matter, non-returning of passport of petitioner cannot be questioned at this stage. However, it is needless to say that if the petitioner has got any grievance against the order passed for impounding of passport, it is always open for him to avail the remedies available to him.

5. With the above observations, the Criminal Petition is disposed of.

6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
