HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No.539 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the appellant.

This writ appeal is against the order, dated 25.03.2015, passed in W.P.No.7773 of 2015, whereby the prayer for seeking direction to respondent No.3 to conduct survey and demarcate the schedule land of the appellant has been rejected. Such prayer is made on the ground that respondent Nos.6 and 7 are raising construction over the appellant's part of the property. In this backdrop, learned Single Judge disposed of the writ petition relegating the appellant to approach the civil Court for seeking appropriate relief. This being a dispute between two private individuals, in our opinion, the order of learned Single Judge does not deserve interference in the intra-court appeal. Writ appeal is accordingly dismissed. All contentions on merits are kept open.

Consequently, miscellaneous petitions, if any, also stand disposed of.
