Janardhan Goud, Advocate for the Petitioner and Addl. Public Prosecutor (TG) for the Respondent, the Court made the following.

Thistriminal Petition, under Section 439 of the Code of Criminal ,Procedure, 1973, is filed by the petitioner/accused, for grant of bail in S.C.No.42 of 2Ol9 on the file of the Special Sessions Judge for Fast Tracking the Cases relating to Atrocities against Women at Khammam. 2.

Heard the learned counsel for the petitioner/ accused, the learned Additionai Public Prosecutor representing the respondent/ State and perused the record.

Learned counsel for the petitioner/accused would submit that the petitioner has been enlarged on bail and attending before the trial Court on each and every clate of hearing. However, the trial Court has issued NBW against the petitioner. The police executed NBW and sent the petitioner to judicial custody on 03.O3.2019 and since then he is in judicial custody. The petitioner is only the bread winner to his family and he has to look after his o1d aged parents and ultimately prayed to grant bail to the petitioner.

The material placed on record reveals that the petitioner/ accused was enlarged on bail and subsequently, due to his absence before the trial Court, NBW was issued against him. Therealter he was arrested and remanded to judicial custody. The petitioner was in judicial custody for more than hundred clays. Having regard to the same, he r:an be enlarged on bail on some conditions.

Accordingly, the petitioner/ accused is ordered to be released on bail on his executing a personal bond for a sum of Rs. 10,O00/- (Rupees ten thousand only) u'ith two sureties in a like sum each to the satisfaction of

., /'{?fslli4 the Special Sessions Judge for Fast Tracking the Cases relating to Atrocities against Women at Khammam. On such release, th'e petitioner/ accused shall appear in-person before the trial court on each and every date of hearing ti1l completion of trial. 6.
