THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.6872 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the order dated 21.03.2016 in Crl.M.P.No.151 of 2016 in Criminal Appeal No.231 of 2016 on the file of VIII Additional Sessions Judge, Ranga Reddy District at L.B.Nagar.

The learned Sessions Judge dismissed the said petition filed by the petitioner against the sentence imposed against him in C.C.No.87 of 2015 on the file of learned VII Special Magistrate, Hasthinapuram, L.B.Nagar, Ranga Reddy District, for the offence under Section 138 of the Negotiable Instruments Act, to undergo Rigorous Imprisonment for a period of six months and also to pay a fine of Rs.3,10,000/- in default to undergo Simple Imprisonment for a period of one month. Heard.

Having perused the material on record and the submissions made by both the counsel, this Criminal Petition is disposed of directing the trial Court to suspend the sentence imposed against the petitioner/accused in C.C.No.87 of 2015 on the file of learned VII Special Magistrate, Hasthinapuram, L.B.Nagar, Ranga Reddy

District, subject to the condition of the petitioner depositing 1/3rd of the fine amount, within a period of one month from the date of receipt of a copy of this order.

Accordingly, this Criminal petition is disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
