THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.21176 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue an appropriate writ, order or direction more particularly one in the nature of the writ of mandamus, declaring the action of the respondents No.2 to 5 in taking action against the Fair Price Shop dealer No.7 of Koppolu Village, Kethepally Mandal by consider the petitioner representation dated 03.04.2017 as illegal arbitrary and against the principles of natural justice and in contrary to provisions of the Control Order 2016 and Essential Commodities Act 1965 and consequently direct the respondents No.2 to 5 to dispose of the petitioner representation dated 03.04.2017 and take appropriate action against the delinquent Fair Price Shop dealer No.7 of Koppolu Village of Kethepally Mandal, Nalgonda District and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner and perused the prayer in the writ petition with supporting affidavit and the other material on record and also heard the learned Government Pleader for Civil Supplies representing the respondents.

It is simple to dispose of the representation of the petitioner, dated 03.04.2017, that the dealer of shop No.7 by name Smt.N.Janamma is not running the shop by her, but appointed a benami contrary to the provisions of the Essential Commodities Act and the rules made thereunder. 4.

As it is the submission of the learned Government Pleader that they are going to dispose of the representation and if there is any truth, they are ready to take action, this writ petition is disposed of, directing the petitioner to give a fresh representation by appearing before the 3rd respondent - Revenue Divisional Officer on 07.07.2017 and the Revenue Divisional Officer shall intimate the further action being taken thereon to the petitioner in writing pursuant to this order. 7.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
