HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.5819 of 2016 ORDER:

The 1st defendant to suit O.S.No.6 of 2016 is the revision petitioner impugning the order of the lower Court in I.A.No.720 of 2016 prohibitory order passed by the lower Court against the 2nd defendant-employer of the 1st defendant prohibiting from payment of the terminal benefits due to the 1st defendant from his superannuation in service and in the suit filed by the plaintiff for marriage expenses against the 1st defendant with a claim of Rs.20,00,000/-. In the course of hearing, both parties arrived at a compromise and the defendant/revision petitioner agreed to pay Rs.6,00,000/- in full quids to the plaintiff for satisfaction of the suit claim to direct the 2nd defendant-employer of him to pay said Rs.6,00,000/- directly to the account of the plaintiff bearing No.

20185774803 of State Bank of India, Warasiguda Branch, Secunderabad, with the name of Yerramalla Annie Priyanka and plaintiff also in the presence of her mother besides sister of defendant agreed for the settlement and accordingly, the revision is disposed of by directing the trial Court to dispose of the suit recording the said admission supra decreeing the plaintiff's suit for Rs.6,00,000/- payable by the 2nd defendant to the 1st defendant out of the terminal benefits to the plaintiff pursuant to the prohibitory order in I.A.No.720 of 2016 in the suit O.S.No.6 of 2016, to pay directly by 2nd defendant said Rs.

6,00,000/- to the said Bank account of the plaintiff and to release only the remaining terminal benefits to 1st defendant and in case of failure, to recover from the 2nd defendant and 1st defendant together or against any of them with interest @ 12% per annum with costs of execution.

Dr.SSRB,J approach the lower Court with copies of the order, for the lower Court to advance the suit and dispose of pursuant to the directions supra. Accordingly and in the result, the revision petition is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
