This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused to quash the order dated 24.03.2014 passed in Crl.R.P.No.56 of 2013 by the Principal Sessions Judge, Khammam, confirming the order dated 10.12.2012 passed in Crl.M.P.No.3079 of in C.C.No.313 of 2008 by the I Additional Judicial Magistrate of First Class, Khammam and to discharge the petitioner from C.C.No.313 of 2008.

Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Learned counsel for the petitioner/ accused would submit that there are no grounds to proceed against the petitioner/ accused.

Learned Additional Public Prosecutor representing the 1st respondent-State opposed to quash the aforesaid order. 5.
As seen from the record, there are concurrent findings by the lower Courts with regard to the accusation against the petitioner/ accused for the offences punishable under Sections 406 and 420 of IPC. There are specific allegations against the petitioner/ accused constituting the offences under Sections 406 and 420 of IPC. There are grounds to proceed against the petitioner/ accused for the said offences.
Under these
circumstances, there are no justifiable grounds to interfere with the order sought to be quashed.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
