CVNR, J SA 938/2017 JUDGMENT:

The concurrent findings of fact regarding execution of a promissory note by the Courts below are assailed in this second appeal. A perusal of the judgments of both the Courts below shows that the main plea of the appellant that he has not executed the promissory note and that the respondent has fabricated the same, was conclusively rejected by the Courts below based on the evidence on record. The findings of fact based on appreciation of evidence do not fall within the realm of substantial questions of law.

The second appeal is therefore dismissed.

As a sequel to dismissal of the second appeal, S.A.M.P. No.1879 of 2017 shall stand disposed of as infructuous.
