THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.24809 OF 2007 ORDER:

The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the inaction of respondent Nos.1 and 2 in conducting enquiry to determine the eligibility of landless poor and sanctioning of house sites and taking appropriate action on the 3rd respondent as per the representation of the petitioners, dated 25.08.2007, as illegal and arbitrary and consequently, direct respondent Nos.1 and 2 to conduct the enquiry to determine the eligibility for the grant of house sites to the petitioners and to grant the house sites.

The averments in the affidavit filed in support of the petition would show that under Vontimitta village Panchayat, there was nearly Acs.39.50 cents of poramboku land, out of which, nearly Acs.11.00 cents of land was allotted by the authorities to the Government offices and also charitable services. Acs.2.00 cents of land, which belongs to Village Panchayat and worth of Rs.50,00,000/-, was unauthorisedly encroached by the 3rd respondent intending to construct houses for upper class persons though there are houseless Scheduled Castes and Backward Classes people, who are eligible for assignment as houseless poor people. On coming to know of the same, the petitioners made a representation, dated 25.08.2007, to the 1st respondent seeking to disperse the land to the eligible landless poor people, but no action has been taken. Hence the writ petition.

3. No representation on behalf of the petitioners. Heard the

learned Government Pleader for Revenue and the learned counsel for the unofficial respondents.

Without going into the merits of the case and having regard to the nature of the prayer sought by the petitioners, the present Writ Petition is disposed of advising respondent Nos.1 and 2 to dispose of the representation, dated 25.08.2007, made by the petitioners, as expeditiously as possible, in accordance with law.
