THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.35319 OF 2015 ORDER:

Sri J. Sridhar, learned counsel representing Sri D. Madhava Rao, learned counsel for the petitioner, states that after the institution of this writ petition and this Court inviting a counter from the authorities setting out the measures taken by them to arrest illegal mining operations and illegal sand transportation in the subject area, the illegal activities have stopped and there is presently no illegal sand quarrying or transportation being undertaken. He would however state that the petitioner is being targeted by the illegal sand quarrying operators for having approached this Court and therefore seeks appropriate directions to protect the petitioner's life and liberty.

In the light of the afore-stated developments, the writ petition is disposed of directing the respondent authorities to keep a strict vigil over the sand quarrying operations in the subject area and take appropriate measures in accordance with law to arrest any illegal operations in this regard. Insofar as the threat to the petitioner is concerned, it shall be open to him to approach the police authorities in the event of any actual apprehension to his life and liberty and the police authorities shall be mindful of the duty cast upon them to prevent commission of any cognizable offence under Section 149 Cr.P.C. and take appropriate steps in the matter. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
