This Criminal Petition, under Section 439(1)(b) of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.15, seeking relaxation of the conditions imposed while granting bail to him by the learned VI Additional Judicial Magistrate of First Class, at Warangal, vide docket order, dated 01.06.2019, passed in Crl.M.P.No.2187 of 2019 in Crime No.110 of 2019 of KUC Police Station, Warangal Urban District.

Heard the learned counsel for the petitioner/ A.15, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned counsel for the petitioner/ A.15 would submit that the petitioner/ A.15 is a Tahsildar, retired in the year 2011. A false case is foisted against him basing on the confessional statement of A.12 and A.14. The name of the petitioner/ A.15 is not figuring in the complaint as well as in the Remand Case Diary Part-I. The Court below, while granting bail to the petitioner/ A.15, imposed a condition to the effect that he shall appear before the Station House Officer, KUC Police Station, Warangal Urban District, once in a week, i.e., on every Sunday between 10: 00 AM and 05: 00 PM within three months or till filing of charge sheet, whichever is earlier. The petitioner underwent bypass surgery in the year 2000 and is suffering from serious heart ailments and ultimately prayed to relax the conditions imposed against the petitioner/ A.15 by the learned Magistrate.

The learned Additional Public Prosecutor did not oppose the relief sought by the petitioner/ A.15.

Having regard to the submissions and the averments made in the affidavit filed in support of this petition, the condition with regard to the appearance of the petitioner/ A.15 before the Station House Officer, KUC Police Station, Warangal Urban District, once in a week, i.e., on every Sunday between 10: 00 AM and 05: 00 PM for three months or till the charge-sheet is filed, whichever is earlier, imposed by the learned VI Additional Judicial Magistrate of First Class, at Warangal, vide docket order, dated 01.06.2019, passed in Crl.M.P.No.2187 of 2019 in Crime No.110 of 2019 of KUC Police Station, Warangal Urban District, is modified as follows: -. The other conditions remained unaltered.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
