ORDER
This writ petition is filed seeking the following relief: "....to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4th respondent in issuing impugned order dt 5.11.2018 bearing Lr.No.01/PACS/ R-18 keeping me under suspension temporarily indefinitely without specifying the date as being illegal, arbitrary, unilateral and unconstitutional and consequently set aside the same and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."
Heard Sri B.Prabhakar, learned counsel appearing for the petitioner, and learned Government Pleader for Co-operation appearing for respondents 1 to 4.
It is the case of the petitioner that he is working as Chief Executive Officer with the respondents. While so, the 4th respondent has placed the petitioner under suspension vide proceedings dated 5.11.2018 on the ground that he had indulged in financial irregularities.
Learned counsel appearing for the petitioner submits that though the 4th respondent has placed the petitioner under suspension vide proceedings dated 05.11.2018, no further action has been initiated; that the case of the petitioner can be reviewed in
terms of G.O.Ms.No.86, dated 08.03.1994; and that appropriate orders be passed in accordance with law.
Learned Government Pleader appearing for the respondents submits that the case of the petitioner would be reviewed and appropriate orders would be passed in terms of G.O.Ms.No.86, dated 08.03.1994.
Having considered the rival submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the respondents to review the impugned suspension order dated 05.11.2018 strictly in terms of G.O.Ms.No.86, dated 08.03.1994 and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order.
