THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.10875 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner inter alia stating that based on her complaint, a case in Crime No.48 of 2018 was registered by the Women Police Station, Control Room, Nampally, Hyderabad, but thereafter, there is no progress in the investigation and the accused therein, respondents 5 to 9 herein, are not arrested.

Heard learned counsel appearing for the petitioner and learned Government Pleader for Home (Telangana) appearing for respondents 1 to 4. Perused the material record. 3.

Learned Government Pleader for Home, on written instructions, a copy of which is placed on record, would submit that after registration of the crime, investigation was taken up; that though a notice was issued to the petitioner calling upon her to produce relevant documents, she failed to produce the documents; that a notice under Section 41(A) of the Code of Criminal Procedure, 1973, was issued, on 17.02.2018, to the first accused, who is the husband of the petitioner herein, directing him to appear before the Investigation Officer, on 19.02.2018; that investigation is at the initial stage; and, that the officer concerned is conducting fair and impartial investigation into the matter.

Recording the said submissions, the Writ Petition is disposed of directing the Investigating Officer to complete the investigation into the aforestated crime as expeditiously as possible and file a final report before the Court of the learned Magistrate concerned by strict adherence to the procedure established by law. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed.
