This writ petition is filed challenging the proceedings dated 24-07-2015, wherein and whereby the petitioner's case was rejected on the ground that circular for mercy petition has come into force with effect from 06-08-2012 and as such her mercy petition dated 02-07-2015 does not fall in the purview of said circular.
Learned counsel for the petitioner submits that the 3rd respondent terminated the petitioner by order dated 23-09-2006 and she filed the appeal and the appellate authority rejected her appeal by proceedings dated 04-03-2015 on the ground of appeal is time barred. Thereafter, the petitioner filed review before the Regional Manager and he rejected the review by proceedings dated 15-06-2015 and advised the petitioner to prefer mercy petition against his proceedings. In pursuance of the circular, dated 06-08-2012, the petitioner filed mercy petition dated 02-07-2015 before the 2nd respondent. But the 2nd respondent without considering the said aspect rejected mercy petition of the petitioner, which is erroneous.

Admittedly, circular dated 06-08-2012 by which provision for filing mercy petition was introduced and the mercy petition is filed on 06-07-2015 against the order dated
15-06-2015 and all are subsequent to the circular. As such, the impugned order is set aside and the 2nd respondent is directed to consider the mercy petition of the petitioner in accordance with law, in view of the circular dated 06-08-2012.
Accordingly, the writ petition is allowed to the extent indicated above. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 24-04-2018 Nvl
