HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4959 of 2015 ORDER:

The petitioner, who is accused No.3 in Crime No.42 of 2015 of Chennuru Police Station, Y.S.R. Kadapa District, registered for the offences punishable under Sections 7 (1) of the Essential Commodities Act and 420 IPC, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

The case of the prosecution is that on credible information about illegal transportation of PDS rice, the Sub-Inspector of police, Chennur PS., along with his staff reached near Gosula College and while they conducting vehicle checking, one mini carriage vehicle was stopped at some distance and two persons got down from that vehicle and tried to escape. Then, the police caught hold of them and on search, the police found PDS rice bags in the vehicle and on interrogation, the 1st person confessed that he is the driver of the said vehicle and the vehicle belongs to the petitioner and on the instructions of the petitioner, they collected the PDS rice from the Fair Price shops at low price and selling the same to the petitioner. Learned counsel for the petitioner submits that on the basis of confession of the other accused only, the petitioner was added as an accused and that the petitioner is nothing to do with the offence alleged against him.

Learned Public Prosecutor submits that the petitioner has involved in '9' other similar cases and the vehicle, which was used in transporting the PDS rice, belongs to the petitioner only. Considering the said facts, this Court is not inclined to grant bail to the petitioner at this stage.

Accordingly, the Criminal Petition is dismissed. ________________ RAJA ELANGO, J June 15, 2015.
