THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37779 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in not registering the case basing on the report, dated 16.09.2016, submitted by the petitioner, as illegal and arbitrary, and consequently direct the 2nd respondent to register the case basing on the report of the petitioner. Heard and perused the material available on record. The main grievance of the petitioner is that he lodged a complaint against one Baddi Venkataramana, Baddi Venkata Lakshmi and Baddi Surya Kiran, before the Station House Officer, III-Town Police Station, Rajahmundry, East Godavari District - 2nd respondent, on 16.10.2016, but the 2nd respondent is not registering the case against said persons.

Considering the grievance of the petitioner, the 2nd respondent is directed to register a case basing on the complaint, dated 16.10.2016, lodged by the petitioner, if the said complaint discloses any cognizable offence and investigate into the same and file a final report if any. In case, the petitioner is aggrieved by the action of the 2nd respondent, he is at liberty to approach the superior officer of the 2nd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J November 04, 2016.
