HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12177 of 2019 ORDER:
The grievance of the petitioner is that the appellate authority, viz., the Revenue Divisional Officer, Parakal Division, Warangal Rural District, is not disposing of his appeal bearing Rc.No.A/523/2018. Perusal of the record reflects that the said appeal was filed as long back as in April, 2018.
In the light of the order proposed to be passed by this Court, there is no necessity to put respondent Nos.5 to 8 on notice or afford them an opportunity of hearing at this stage. A hierarchy of remedies is provided under the Telangana Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act of 1971'), to ensure that speedy justice is made available to the citizens. It is not open to a statutory authority who is entrusted with quasi-judicial duties in terms of the Act of 1971 to delay the disposal of cases.
Be it noted that valuable property rights of the parties would be at stake and the delay on the part of the quasi-judicial authority would adversely impact such rights.
The Writ Petition is accordingly disposed of directing the Revenue Divisional Officer, Parakal Division, Warangal Rural District, to dispose of the petitioner's pending appeal in Rc.No.A/523/2018 expeditiously and in any event, not later than three months from the date of receipt of a copy of this order, be it from whatever source. Pending Miscellaneous Petitions, if any, shall also stand closed
