JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) The petitioner in H.O.P.No.5 of 2002 on the file of the learned Senior Civil Judge at Bobbili, filed C.M.A.No.1014 of 2005 against order and decree, dated 30.08.2005, whereby the learned Judge dismissed the said H.O.P. filed for dissolution of marriage with the respondent.

The parties are hereinafter referred to as they are arrayed in C.M.A.No.1014 of 2005.

The appellant filed I.A.No.1 of 2018 for recording the terms and conditions contained in memorandum of compromise, dated 02.11.2018, and allowing the appeal. He has also filed I.A.No.2 of 2018 for amendment of the prayer in H.O.P.No.5 of 2002 in order to facilitate grant of decree for divorce by mutual consent under Section 13-B of the Hindu Marriage Act, 1955.

At the hearing, both the parties are personally present. They have confirmed the fact that they entered into a settlement by signing the aforementioned memorandum of
compromise along with their counsel. The respondent has informed the Court that as per the settlement, the appellant has paid Rs.39,00,000/- (Rupees thirty-nine lakhs only) in full and final settlement of all her claims. The parties have agreed that their children will remain with the respondent. The terms of the aforementioned memorandum of compromise filed along with I.A.No.1 of 2018 shall form part of this order.

In the light of the compromise arrived at between the parties, I.A.Nos.1 and 2 of 2018 and C.M.A.No.1104 of 2005 are allowed. H.O.P.No.5 of 2012, as amended, is allowed by granting decree for dissolution of marriage by consent of both the parties in terms of the memorandum of compromise referred to above.
