THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.11563 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief: "... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the Letter No.613/A/2016, dated 09-03-2017 issued by the 2nd respondent as illegal, arbitrary, and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the respondent Nos.2 to 4 herein to provide membership to the petitioners in the Fishermen Cooperative Society, Komatlagudem village, Konijerla Mandal, Khammam district, without reference to the caste." 2.

When the matter is called, it is represented by the learned counsel for the petitioners as also the learned Government Pleader that the issue in the present writ petition is squarely covered by the Judgment of this Court in W.P.No.34793 of 2013, dated 20.11.2015, and the copy of the same is placed on record along with writ petition as material paper.

In view of the above judgment and for the reasons recorded therein, this writ petition is allowed, setting aside the Letter.No.613/A/2016, dated 09.03.2017, and the 3rd respondent is directed to consider the applications of the petitioners for admission in to the 4th respondent/society strictly in accordance with G.O.Ms.No.74, Animal Husbandry, Dairy Development and Fisheries (F.II) Department, dated 21.10.2011, without reference to the castes to which the

petitioners belong. This exercise shall be completed within eight weeks from the date of receipt of this order. Miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
