HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37164 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India challenging the registration of FIR No.213 of 2013 by the 4th respondent on the reference made by XVII Additiona Chief Metropolitan Magistrate, Nampally, Hyderabad under Section 156(3) Cr.P.C.

Heard and perused the material available on record. 3.

The main grievance of the petitioners is that there are several disputes between the petitioners and the 5th respondent and his wife right from January, 2010 onwards and that the 5th respondent is filing false complaints against the petitioners one after the other with all false allegations. It is stated that civil disputes are pending between the parties. 4.

The petitioners filed this writ petition challenging the investigation of the crime registered in the year 2013. This Court is not inclined to interfere with the investigation. However, taking into consideration the circumstances of the case, this Court is of the view that the investigation can be completed without arresting the petitioners. 5.

Accordingly, respondents Nos.2 to 4 are directed to complete the investigation and file a final report in the above Crime, in accordance with law, without arresting the petitioners.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
