ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.53 of 2026 before the Jainath Police
Station, Adilabad District, registered for the offences punishable under Sections 118(2), 351(2) of BNS and Sections 3(1)(s), 3(2)(va) of SC/ST POA Act.

The brief facts of the case are that on 01.03.2026, due to a dispute over repayment of Rs.1,000/-, the accused allegedly abused the complainant by referring to his caste name and subsequently attacked him with a knife near Savari Bungalow, causing injury to his neck. The complainant later lodged a report on 02.03.2026 before the police of Jainath Police Station, upon which a case was registered and investigation was taken up.

Heard Sri Gajanand Chakravarthy, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.
Learned counsel for the petitioner submitted that the petitioner was innocent and falsely implicated, and that the allegations were vague and exaggerated without specific overt acts and that though an earlier bail petition was dismissed on
the ground of grievous injury, no medical record or wound certificate was produced to substantiate the same, which constitutes a change in circumstances. He further submitted that the incident arose out of a sudden quarrel without premeditation, the injuries were simple in nature, and the ingredients of serious offences were not made out. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this Criminal Petition.

Learned Additional Public Prosecutor opposed the petition contending that the petitioner abused the complainant in the name of caste and attacked him with a knife, causing injury on a vital part of the body, which indicates intention to cause serious harm. He further submitted that the allegations are grave in nature, the investigation is in progress, and custodial interrogation may be required. Hence, the petitioner is not entitled to grant of bail.

In the light of the submissions made by both sides and on perusal of the material available on record, it appears that the allegations in the complaint are that, owing to a dispute
relating to repayment of money, the petitioner abused the complainant by referring to his caste name and thereafter attacked him with a knife, causing injury on the neck. The main allegation against the petitioner is that he assaulted the complainant during the course of the said quarrel. As seen from the record, the learned Additional Public Prosecutor has placed before this Court the medical certificate, which discloses that the injuries sustained by the complainant are simple in nature. Considering the facts and circumstances of the case, the nature of the allegations, the nature of injuries sustained by the complainant, this Court deems it fit to grant anticipatory bail to the petitioner, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Jainath Police Station, Adilabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight
(8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
