THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI A.S. No.2439 of 1999 JUDGMENT:
On 24.01.2018, this Court having considered the representation that Sri Kolluru Jagannadha Rao, learned counsel appearing for the appellant, is a non-practicing advocate, directed the Registry to print the name of Sri P. Suresh, learned counsel for the appellant, along with the name of the said counsel, and list the matter on 05.02.2018.
On 05.02.2018, there was no representation for the appellant. Hence, the matter was directed to be listed today under the caption "for dismissal". However, learned counsel representing Sri M.V.S. Suresh Kumar, learned senior counsel appearing for the fifth respondent, was present. Today also, despite the matter being listed under the caption "for dismissal", there is no representation for the appellant. The above conduct of the appellant indicates that he is not interested in prosecuting the Appeal Suit.
The Appeal Suit is accordingly dismissed for default. No order as to costs. Miscellaneous petitions, pending if any, also shall stand dismissed.
