HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18095 of 2016 ORDER:

Heard learned counsel for the petitioner as well as the learned Government Pleader for Home and with their consent, this writ petition is being disposed of, at the admission stage.

This writ petition is filed by the petitioner seeking Mandamus declaring the action of respondent Nos.2 to 4 in not arresting and not taking any action against respondent No.5 and others in spite of registration of FIR.No.870 of 2015, dated 31.12.2015 of 4th respondent Police Station and also on the complaint dated 03.03.2016 of the petitioner, as illegal, arbitrary, unjust and against the provisions of Article 300-A of the Constitution of India and consequently sought a direction to respondent Nos.2 to 4 to cause arrest of respondent No.5 and others for their illegal interference and trespass into the petitioner's property i.e., all that piece and parcel of land in four open plots bearing Nos.7, 8, 9 and 10, admeasuring 1068 square yards in Sy.No.58, situated at Ward No.8, Block No.3, rest of area of Karmanghat Village, Saroornagar Mandal, Ranga Reddy District. Though various grounds are raised in the writ petition, learned counsel for the petitioner sought a direction to respondent No.4 - Station House Officer,

Meerpet Police Station, Cyberabad, Ranga Reddy District, to investigate into Crime No.870 of 2015, dated 31.12.2015 registered for the offences punishable under Sections 447 and 506 of IPC in accordance with law and file a final report at the earliest.

On the other hand, the learned Government Pleader for Home (Telangana) submits that the allegations made in the aforesaid FIR are all false and the police are investigating the matter in accordance with law. Since this Court is not going into the merits of the matter, it is not necessary to issue notice to the unofficial respondent i.e., respondent No.5.

Having regard to the facts and circumstances stated above and without going into the merits of the case, this writ petition is disposed of directing respondent No.4 to investigate into Crime No.870 of 2015 of S.H.O., Meerpet Police Station, Cyberabad, Ranga Reddy District, in accordance with law and file a final report as early as possible. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
