THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1339 OF 2015 ORDER:
The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 23.06.2015 passed in Crl.M.P.No.387 in 2015 in Crime No.131 of 2015 on the file of the Court of the I Additional Judicial First Class Magistrate, Huzurabad, Karimnagar, whereby the learned trial Judge directed to return the black jaggery on condition of the petitioner executing a personal bond for a sum of Rs.2,00,000/- (Rupees two lakhs only).
Heard and perused the material available on record. Learned counsel for the petitioner submits that the value of the jaggery is Rs.1,50,000/- only and as such, prays this Court to reduce the value of the personal bond for a sum of Rs.1,50,000/- instead of Rs.2,00,000/- as ordered by the Court below.
Considering the facts and circumstances of the case, this Court directs the Police Station concerned to release the black jaggery alone to the petitioner herein on execution of personal bond of Rs.1,50,000/- (Rupees one lakh fifty thousand only) with one surety to the satisfaction of the authorities concerned.
With the above direction, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed.
