O R D E R
The case of the petitioners is that they are the tenants of the 4th respondent, and in the subject property, they are carrying on gunny business. The 4th respondent is demanding them to vacate the subject property, for which they sought time. In stead of giving reasonable time to vacate the premises and in case of their default, availing the common law remedy of filing the suit for eviction in accordance with law, approached the 3rd respondent - Station House Officer, Tuni Town Police Station. The 3rd respondent, at the instance of the 4th respondent, summoned the petitioners to the police station on 1.07.2017 and threatened them with dire consequences, demanded them to vacate subject property by 15.07.2017, obtained their signatures on blank papers and handedover them to the 4th respondent. Aggrieved by the alleged highhanded action of the 3rd respondent in interfering with the civil dispute, the present writ petition came to be filed.
The learned Government Pleader for Home, on instructions, submits that the 3rd respondent neither summoned the petitioners to the police station, nor interfered with any civil disputed as alleged by the petitioners and however if any action is sought to be taken, the same would be dealt with in accordance with law.
Recording the above statement and without expressing any opinion on merits, the writ petition is disposed of at the stage of admission , directing the 3rd
respondent not to interfere with the civil dispute, if any, between the petitioners and the 4th respondent. However, if any crime is registered, the same shall be dealt with in accordance with the procedure established under law. No order as to costs.
