THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7484 OF 2017 O R D E R :

This Writ Petition has been filed seeking a mandamus to declare the inaction on the part of Respondents 2 and 3 - Greater Hyderabad Municipal Corporation in granting occupancy certificate, 'No Objection Certificate' and releasing the mortgaged flats, as illegal and arbitrary.

The case of the petitioner is that he raised an apartment complex in Plots No. 175 and 176, Survey Nos. 60 Part, 650 Part and 651 situated at Gopal Reddy Nagar, Vampuguda, H/o Kapra after obtaining necessary permission from the 3rd respondent. Thereafter, on 11.12.2016, when he approached the respondent authorities for obtaining occupancy certificate and to get release the mortgaged flats, they have not responded thereon. Heard learned counsel for the petitioner as well as Sri Pasham Krishna Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation.

Since the main grievance of the petitioner is that the respondent authorities are not granting occupancy certificate and also not releasing the mortgaged flats, it would be appropriate for this Court to direct the respondent authorities to consider the request of the petitioner and take necessary action with regard thereto, in accordance with law.

With this, the Writ Petition stands disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
