THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.10100 OF 2018 ORDER:
Heard counsel for the petitioners and Sri Nimmagadda Venkateswarlu, Standing Counsel for the respondent.
2. Standing Counsel for the respondent has produced layout copy of the colony, which is the subject matter of this Writ Petition, where the respondent is proposing to construct a compound wall around the existing open space.
3. Counsel for the petitioners contends that a compound wall is being erected by the respondent municipality without leaving any gap between the plots of the petitioners and the open space, though, there is 20 feet road shown between the plots of the residents of the colony and the open space earmarked for park in the said layout bearing L.P.No.38/2000.
4. Standing Counsel for the respondent assures that while constructing compound wall around the existing open space/park in the subject colony, 20 feet gap would be left between the compound wall proposed to be constructed by the respondent and the plots of the residents of the colony, including that of the petitioners,.
5. In view of the said assurance given by the respondent, the Writ Petition is disposed of directing the respondent to leave 20 feet road gap between the compound wall proposed to be constructed
around the open space/park in the subject colony and the plots of the petitioners and other residents on the four sides of the said open space/park.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ____________________________ M.S.RAMACHANDRA RAO, J April 23, 2018.
