HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No.176 of 2012 JUDGMENT:

This appeal is filed questioning order dated 01.02.2012 in I.A.No.804 of 2011 in O.S.No.24 of 2011 on the file of Family Court-cum-Additional District Judge, Vizianagaram.

2. Appellant herein is plaintiff, who filed I.A.No.804 of 2011 before the Court below seeking temporary injunction and the Court below on a consideration of material on record dismissed the application and vacated temporary injunction granted on 14.06.2011.

Aggrieved by the same, present appeal is preferred.

3. As per the office note, the suit before Court below was dismissed as not pressed in view of the memo filed by both parties. As the main suit itself is disposed of, nothing survives in this appeal.

4. Therefore, this appeal is dismissed as infructuous.

5. Miscellaneous petitions pending, if any, shall stand closed. No costs.
