HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1736 OF 2017 ORDER:

It is the case of the petitioner that though he filed appeal before the 2nd respondent on 16.12.2016 against the eviction orders passed by the 1st respondent vide proceedings Rc.B1/1944/1/2015, dated 09.10.2016 along with stay petition and same is pending, the respondents are trying to dispossess the petitioner from the subject property. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader for Revenue, on instructions submits that appeal filed by the petitioner is received by the 2nd respondent and it is at the stage of numbering. In view of the same, the 2nd respondent is directed to dispose of the appeal filed by the petitioner against the proceedings of the 1st respondent dated 09.10.2016 in accordance with law, after issuing notice to the parties to the appeal and after affording an opportunity of hearing to both parties. Till such orders are passed by the 2nd respondent, interim order granted on 19.01.2017 shall continue. With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of the writ petition, miscellaneous petitions, if any, pending shall stand closed.
