HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 46113 of 2016 Order:
This Writ Petition was filed by cousins challenging the registration of Crime No.220 of 2016 dated 10.11.2016 on the basis of complaint of the fourth respondent.
The fourth respondent lodged a complaint with the third respondent on 10.11.2016 stating that when he entered the land in Survey Nos.549 and 540 along with Panchayat Secretary to conduct an enquiry with regard to damage to the pathway, the petitioners created nuisance and obstructed them while discharging their legitimate duties and pushed him by using vulgar language.
On the face of the said complaint, it cannot be said that the registration of crime is bad in law. This Court cannot interfere with the registration of crime in exercise of its power under Article 226 of the Constitution of India and it is for the third respondent to conduct an investigation with regard to the allegations made in the complaint. This Court sees no ground to interfere.
The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
