THE HONOURABLE SMT. JUSTICE P.SREE SUDHA CRIMINAL REVISION CASE No.1967 of 2010 ORDER:

This Criminal Revision Case is filed against the order dated 29.06.2010 in M.C.No.426 of 2008 passed by the Judge, Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad. 2.

M.C.No.426 of 2008 is filed for maintenance of the minor daughter aged five years and represented by natural mother against her husband i.e., revision petitioner. There no dispute regarding marriage and paternity of the child. 3.

It is stated that the revision petitioner is working as an Agriculturist and earning Rs.20,000/- per month. It is further stated that the respondent requires an amount of Rs.3,000/- per month towards educational expenses. Mother of the 1st respondent by name Smt. Amaravathi is working as A.N.M. in Government hospital, Gummadavalli, Kandukur Mandal, Ranga Reddy District and earning Rs.12,000/- per month. 4.

Considering the facts and circumstances of the case and duly considering the earnings of the mother of the 1st respondent-child and also occupation and earnings of the father, the trial Court directed the revision petitioner to pay

Rs.2,000/- per month towards the maintenance of the 1st respondent-child.

Aggrieved by the said orders, the revision petitioner preferred the present criminal revision petition. 6.

Revision petitioner contended that the trial Court did not observe the fact that his wife is a Government employee and he is an agricultural labour and that the paying capacity of the parties was not ascertained by the trial Court. 7.

The trial Court examined PW1 and also RW1 and rightly granted Rs.2,000/- per month towards maintenance of the minor child and the revision petitioner cannot escape from paying maintenance to his minor daughter on the ground that he has no paying capacity.

Therefore, the present Criminal Revision Case is devoid of merit.

Accordingly, the Criminal Revision Case is dismissed. 9.

Miscellaneous petitions pending, if any, shall stand closed.
