THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.12174 of 2019 ORDER:

This writ petition is filed challenging the Provisional Assessment notice, dated 08.03.2019, issued by the 5th respondent, whereby the petitioner was asked to pay 50% of the assessed amount i.e., Rs.2,40,518/- for restoration of power supply, without affording any opportunity of being heard.

Heard learned counsel for the petitioner and Sri R.Vinod Reddy, learned Standing Counsel for the respondents. 3.

Learned counsel for the petitioner submits that the petitioner has not committed any irregularity and not involved in any offence. He further submits that the petitioner is unable to pay the said amount at a time.

In this case, it is to be seen that the petitioner was asked to pay 50% of the assessed amount, the same cannot be found fault. However, the petitioner is permitted to pay 50% of the assessed amount in two equal monthly installments within two months and on payment of the 1st installment, the power connection shall be restored. If the petitioner fails to pay the 2nd installment, it is open to the respondents to take action as per Section 154 of the Electricity Act. However, the payment made by the petitioner shall be subject to final determination under Section 126(4) of the Electricity Act. 5.

With the above direction, the writ petition is disposed of.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
