HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12212 of 2019 ORDER:
The petitioner is aggrieved by the inaction on the part of the Tahsildar, Warangal Mandal, Warangal Urban District, in effecting mutation in his favour and issuing him a pattadar pass book/title deed in relation to the land claimed by him.
Perusal of the record reflects that the petitioner merely submitted a representation on 18.12.2018 in this regard without following the prescribed procedure.
Be it noted that Section 4 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, read with Rule 18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989, requires an application to be given in Form VIA online along with the requisite fee and proper documents.
Without abiding by the prescribed procedure, it is not open to the petitioner to complain of inaction on the part of the revenue authorities.
The Writ Petition is accordingly disposed of permitting the petitioner to make an application in the prescribed format in Form VIA along with the requisite fee and necessary documents to the Tahsildar, Warangal Mandal, Warangal Urban District. In the event such an application is made, the Tahsildar, Warangal Mandal, Warangal Urban District, shall take appropriate action thereon expeditiously and in any event, not later than four weeks from the date of receipt thereof.
