THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4562 OF 2023 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 7973 (for short 'Cr.P.C.') by the petitionerAccused to quash the docket order dated 24.04.2023 in STCNI/0000007/2021 pending on the file of Learned Prl.Junior Civil Judge, at Asifabad. The offences alleged against them are under Sections 138 of N.I.Act 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for respondent - State. Perused the material on record.

Learned counsel appearing for the petitioner would submit that though part of the amount is already paid, the police are coming to the petitioner's residence on the basic of NBW issued. Learned counsel for the petitioner would submit that the next date of hearing is 15.05.2023 and the petitioner undertakes to appear on the said date.

In the said circumstances, this Court deems it fit, in the event of petitioner appearing before the trial Court and filling application under Section 70(2), the same shall be allowed on conditions to be imposed by the trial Court.
