HONOURABLE SRI JUSTICE S.RAVI KUMAR WRIT PETITION No.4799 OF 2003 ORDER:

This writ is filed to declare proceedings dated 9-4-2001 of third respondent as illegal and consequently direct the respondents to declare the case of petitioner for appointment to the post of LDC/Typist or any other suitable vacancy as per B.P.Ms.No.36 dated 18-5-1997.

According to affidavit of the petitioner, he joined as casual labour and after prolonged agitation from various unions, APSEB has issued B.P.Ms.No.36, dated 18-5-1997, as per which 50% of the existing vacancies for the cadre of LDC/Typist have to be given to service candidates. Heard both sides.

Advocate for petitioner herein submitted that petitioner herein submitted a representation to the respondent on 1612-2013 and the present writ petition can be disposed of by directing the respondent to consider petitioner's representation as per the rules and circular in B.P.Ms.No.36 dated 18-5-1997.

Advocate for respondents submitted that B.P.Ms.No.36, dated 18-5-1997 is not in force as on today and it is withdrawn.

Learned advocate for petitioner in response to the

same, submitted that let the representation be considered if petitioner is otherwise eligible as per the rules of the respondents.

Considering the submissions of both sides, I feel that the writ petition can be disposed of directing the respondents to consider representation of the petitioner dated 16-122013, if he is otherwise eligible as expeditiously as possible preferably within three months and pass appropriate orders in accordance with rules.

This writ petition is accordingly disposed of. No costs. As a sequel to the disposal of this writ petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
