HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.39025 of 2013 ORDER:
This writ petition is filed questioning the action of the respondents 1 to 3 in not taking any action in respect of the representations dated 07.02.2013 and 16.09.2013 against the illegal construction made by some of the persons in the unapproved lay out at Currency Nagar, Vijayawada, Krishna District, as illegal and arbitrary.
Counter-affidavit has been filed by the 2nd respondent stating that the representation dated 07.02.3013 made by the petitioner was disposed of on 19.02.2013 duly informing that the neighbour of the petitioner site on the northern side has erected 8 fencing poles unauthorizedly to protect his vacant land and the said unauthorised poles were removed and the petitioner was also informed about the same. It is further stated that the respondent-Corporation issues building permission strictly in accordance with the provisions under G.O.Ms.No.168 M.A. dated 07.04.2012; and that as and when the unauthorised constructions or illegal constructions came to the notice of the Respondent-Corporation, it initiates immediate and necessary action strictly, as per the provisions of the HMC Act, 1955. As the representation dated 07.02.
2013 of the petitioner was duly considered and disposed of on 19.02.2013 by the 2nd respondentCorporation, no further orders are necessary in this writ petition. The writ petition is, accordingly, closed.
by any persons in the subject unapproved lay out, he is at liberty to file fresh representation before the 2nd respondent. If any such representation is made by the petitioner, the 2nd respondent is directed to pass appropriate orders thereon, in accordance with law. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
