THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO.16242 OF 2016 ORDER:

This writ petition is filed seeking to issue writ of mandamus declaring the action of the 3rd respondent in issuing proceedings No.GP8/2016, dated 05-05-2016 as illegal and arbitrary.

2. Learned counsel appearing for the petitioner confines his challenge to the impugned notice to the limited extent of permitting the petitioner to submit explanation to the notice, dated 05-05-2016 within seven (7) days from today.

3. Learned standing counsel appearing for Gram Panchayat says no objection to grant time to the petitioner to submit explanation.

4. Accordingly, the writ petition is disposed of by giving liberty to the petitioner to submit explanation to the notice, dated 05-05-2016, within seven (7) days from today and the authorities are directed to consider and take appropriate action in accordance with law. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
