This criminal petition is filed by the petitioner/A7 under Sections 480 and 483 of the Bharatiya Nagrik Suraksha Sanhita (BNSS) seeking regular bail in S.C.No.169 of 2022 on the file of the Metropolitan Sessions Judge, Cyberabad, Ranga Reddy District at L.B. Nagar, registered for the offence punishable under Section 20(b)(ii)(C) of the Narcotic Drugs And Psychotropic Substances Act, 1985 (for short, "the NDPS Act"). 2.
Heard Sri Mohd. Fasiuddin, learned counsel for the petitioner, and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent.

Learned counsel for the petitioner submits that the petitioner is accused No.7 in Crime No.1082 of 2021 on the file of Vanasthalipuram Police Station, Rachakonda Commissionerate, registered for the above said offence and he was arrested on 17.12.2021. He further submits that in S.C.No.169 of 2022 the petitioner was granted bail on
13.05.2023, but he has not been released on the ground that he was produced in another case basing on PT warrant and sent to jail. He further submits that the petitioner is ready and willing to cooperate for disposal of S.C.No.169 of 2022. He further submits that accused No.1 in the said case filed Crl.P.No.4376 of 2025 and this Court allowed the same vide order dated 03.04.2025. Therefore, the petitioner is also entitled for grant of bail. 4.
Learned Additional Public Prosecutor has not opposed the submissions made by the learned counsel for the petitioner.

Having considered the rival submissions made by both the parties and after perusal of the material available on record, it reveals that the petitioner is accused No.7 in Crime No.1082 of 2021. In S.C.No.169 of 2022 he was granted bail on 13.05.2023. However, he was not released on the ground that he was produced in another case basing on PT warrant and since then he is in jail.

Taking into consideration the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner on the following conditions: (1) The petitioner/A7 is enlarged on bail on executing a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties for a like sum each to the satisfaction of the XXIV Additional Metropolitan Magistrate, Cyberabad at Hayathnagar.
(2) The petitioner/A7 shall given an undertaking that he will appear before the Court below in S.C.No.169 of 2022 and prosecute the proceedings regularly.
(3) After release, the petitioner/A7 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the criminal petition is allowed. Pending miscellaneous applications, if any, shall stand closed.
