HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Transfer Civil Miscellaneous Petition No.181 of 2018 ORDER:

Heard Sri A.K. Kishore Reddy, learned counsel for the petitioner-wife and Smt. M. Madhavi Priya, learned counsel for the respondent-husband.

Learned counsel for the petitioner would submit that the petitioner-wife has been taking shelter at her parents house at Kakinada, East Godavari District. She has also filed M.C. No.39 of 2017, which is pending on the file of IV-Additional Judicial Magistrate of First Class, Kakinada, East Godavari District, seeking maintenance. Certain other allegations have been made in paragraphs 3, 4 and 5. But, however, there is no resistance so far as transfer of the present F.C.O.P. is concerned and for the reason that M.C. No.39 of 2017 is also pending with the learned IV-Additional Judicial Magistrate of First Class, Kakinada, East Godavari District, where the respondent-husband invariably has to attend for enquiry and also keeping in view, the submission that the petitioner-wife has been taking shelter at her parents house at Kakinada, the request made by the petitioner can be acceded to.

Accordingly, the present Transfer Civil Miscellaneous Petition is allowed. F.C.O.P. No.2324 of 2017 pending on the file of XV-Additional District Judge-cum-Family Court, Rangareddy District at Miyapur, is withdrawn and transferred to the file of Principal Senior

Civil Judge, Kakinada, East Godvari District. The transferee Court shall issue notices to both parties on receipt of case bundle and dispose of the F.C.O.P. in accordance with law. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions if any pending in the Transfer Civil Miscellaneous Petition shall stand closed. ________________________ A.SHANKAR NARAYANA Dt. 16.04.2018 gbs
