HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 23247 of 2016 ORDER:

Heard learned counsel for the petitioners and Government Pleader for Mines and Geology.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not extending the period for lifting of balance quantity of sand from the approved stockyards in pursuance of the orders of the 1st respondent in Memo No.7985/M.III (2)/2014, dated 28.01.2016 and the action of the 1st respondent in not considering and passing orders on the representations of the petitioners dated 07.03.2016 and 29.04.2016, as illegal, arbitrary and violative of principles of natural justice.

Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts her prayer seeking a direction to the 1st respondent to dispose of the petitioners' representations dated 07.03.2016 and 29.04.2016 at the earliest. Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the 1st respondent to dispose of the representations dated 7.03.2016 and 29.04.2016 made by the petitioners, in accordance with law, as expeditiously as possible, preferably within a period of ten (10) days from the date of receipt of a copy of the order, if the same are still pending consideration. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
