THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.38023 of 2015 ORDER:
The grievance of the petitioner was that the police authorities, respondents 4 and 5, were harassing him and his family members by calling them to the police station and misbehaving with them. This harassment was stated to be at the instigation of the sixth respondent, the uncle of the petitioner's wife.
The Inspector of Police, Kasibugga Police Station, Srikakulam District, furnished written instructions dated 02.12.2015 to the office of the learned Government Pleader for Home, wherein he stated that the petitioner's wife, Malla Manasa, lodged a complaint on 30.08.2015 with the Kasibugga Police Station alleging mental and physical harassment for additional dowry by her husband and his family members. Upon the said complaint, the police attempted to conduct a counselling but the matter was not settled as the petitioner was not available. It is in this context that the police stated that they tried to contact the petitioner over the phone. After enquiring into the matter thereafter, the police registered Crime No.230 of 2015 under Section 498-A I.P.C. read with Sections 3 and 4 of the Dowry Prohibition Act, 1961, on 25.11.2015. The petitioner and his family members were stated to have been shown therein as the accused. The matter is stated to be under ongoing investigation.
In the light of the afore-stated developments, the petitioner can have no grievance with regard to the interference by the police authorities with his life and liberty. As he is shown as an accused in a criminal offence, the police are bound to investigate the matter and in that context, subject him to interrogation and examination. Needless to state that the same should be in strict accordance with the procedure prescribed under the Code of Criminal Procedure, 1973. Subject to the above observations, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall also stand
dismissed. No order as to costs.
