THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2075 OF 2015 ORDER:
This Criminal Revision Case is filed by the accused No.2 challenging the order of the II AJCJ-cum-XIX Metropolitan Magistrate, Cyberabad, Kukatpally at Miyapur dated 20.08.2015 whereby the learned Judge dismissed Crl.M.P.No.2884 of 2015 in C.C.No.1602 of 2014 filed under Section 239 Cr.P.C. to discharge her from the charges.
After arguing for some time, when this Court expressed the view that the trial to be continues, the learned counsel for the petitioner confined his argument to the extent of dispensing with the presence of the petitioner before the trial Court. Since the offence alleged against the petitioner is under Section 498-A IPC, the question of her identity before the trial Court does not arise.
In the circumstances, the presence of the petitioner before the trial Court is dispensed with except on the dates so specifically the trial Court insists for her appearance. The petitioner is directed to be represented by a counsel on all hearing dates.
The Criminal Revision Case is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
