HON'BLE SRI JUSTICE R. SUBHASH REDDY AND HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.39995 OF 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed questioning the e-auction sale notice, dated 12.11.2015, issued under the provisions of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 by the respondent - Bank fixing the date of auction as 14.12.2015.

When the matter is called, it is submitted by the learned counsel for respondent - Bank that pursuant to the e-auction notice, dated 12.11.2015, no auction was held on 14.12.2015 for want of bidders.

As the auction was not held on 14.12.2015, we are of the view that nothing survives for adjudication in this Writ Petition.

Accordingly, the Writ Petition is dismissed as infructuous. However, it is made clear that if any fresh auction notice is issued, it is open to the petitioner to avail the remedies available under law.

Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
