HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5960 of 2016 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

The order dated 4.12.2015 passed by the third respondent suspending the Fair Price Shop authorization of the petitioner pending enquiry is challenged before this Court. Inasmuch as the impugned order dated 4.12.2015 is appealable, the petitioner filed an appeal before the second respondent-Joint Collector on 6.2.2016 and the same is pending adjudication. In view of the same, this Court is not inclined to go into the merits or otherwise of the subject matter in the present Writ

Petition. However, in the interest of justice, the second respondent is directed to dispose of the appeal preferred by the petitioner against the order dated 4.12.2015 within a period of four weeks from the date of receipt of a copy of this order, on merits and in accordance with law, by affording sufficient opportunity of being heard to the petitioner.

Subject to the above, the Writ Petition is disposed of at the admission stage.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
