THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.24287 of 2017 ORDER:

This writ petition is filed questioning the notice, dated 09.07.2017, issued by the respondent Municipality asking the petitioner to remove the building located in the subject land. Heard the learned counsel for the petitioner and Sri Saleem for the respondent Municipality.

The grievance of the petitioner in the present writ petition precisely is that without being preceded by any notice and without affording any opportunity of hearing, the respondents are seeking to demolish the subject building constructed by her.

On the other hand, it is submitted by the learned Standing counsel that if the petitioner submits any explanation even now, the respondents will consider the same and take appropriate action in accordance with law. Recording the said submission, the writ petition is disposed of keeping it open for the petitioner to submit an explanation to the respondent Municipality with regard to the subject construction, within a period of one week from the date of receipt of a copy of this order and if any such explanation or representation is submitted within the time stipulated, the same shall be considered and appropriate action be taken by the respondents in accordance with law by passing suitable orders, after giving notice to the petitioner.

Till then status quo with regard to the subject property shall be maintained.
