THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T PETI TI ON No.19023 of 2015 ORDER:

This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the respondents in terminating the petitioner from service as Field Assistant at Uppaladinne Gram Panchayat, Ponnaluru Mandalam, Prakasam District, vide proceedings No.D5/1398/EGS/2014, dated 27.04.2015, without considering the explanation of the petitioner, as illegal and arbitrary, and consequently to direct the respondents to reinstate the petitioner into service as Field Assistant at the same place. Heard Sri Tenepalli Niranjan, learned counsel for the petitioner and Sri M.S.R.Chandra Murthy, learned standing counsel for respondents Nos.3 & 4.

It has been contended by the petitioner that she was appointed as a Field Assistant and she has been discharging her duties without any complaint. However, respondent No.3 has terminated the services of the petitioner, vide orders dated 27.04.2015 without considering the explanation submitted by the petitioner. It has further been contended by the petitioner that she has preferred an appeal to respondent No.2 on 20.06.2015 and the same is pending and therefore, she prays this court to give a direction to respondent No.2 for early disposal of her appeal. Learned standing counsel appearing for respondents Nos.3 & 4 has not raised any objection to give a direction for early disposal of the appeal filed by the petitioner.

In view of the above, without expressing any opinion on the merits of the case, the writ petition is disposed of, directing respondent No.2 to

AKS,J WP_19023_2015 take up the appeal filed by the petitioner for hearing and pass appropriate orders thereon, in accordance with law, within a period of 8 (eight) weeks from the date of receipt of a copy of this order. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
