THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.13348 of 2015 ORDER:

1. This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioner/A.5 in C.C.No.306 of 2015 on the file of the Judicial Magistrate of First Class, Special Mobile Court, Kakinada, East Godavari District.

2. When the matter is taken up for hearing, the learned Counsel for the petitioner has sought permission of the Court to withdraw the criminal petition with liberty to avail the remedies available to him under law. He further requested the Court to dispense with the presence of the petitioner before the trial Court on each and every date of adjournment.

3. There is no dispute with regard to the identity of the petitioner, who is accused No.5, in C.C.No.306 of 2015 on the file of the Judicial Magistrate of First Class, Special Mobile Court, Kakinada. Even if the presence of the petitioner is dispensed with, no prejudice will be caused to the 2nd respondent/defacto complainant.

4. Accordingly, this Criminal Petition is dismissed as withdrawn, by dispensing with the presence of the petitioner, who is accused No.5, in C.C.No.306 of 2015 on the file of the Judicial Magistrate of First Class, Special Mobile Court, Kakinada, East Godavari District, on each

and every date of adjournment. However, he shall appear before the trial Court as and when his presence is so required.
